The Terrorism (Protection of Premises) Act, also known as Martyn’s Law, came into effect on 3 April 2025. This new legislation requires organisations, including educational establishments, to improve safety measures for public places in case of a terror attack. These key requirements aim to mitigate the impact of a terrorist attack, helping to reduce the risk of physical harm to the public.

The Security Industry Authority (SIA) will be responsible for overseeing and enforcing Martyn’s Law, giving schools and organisations until the 3 April 2027 to prepare. Additionally, simple and accessible guidance will become readily available from the Home Office throughout the implementation period.

As part of the key communication requirements of Martyn’s Law, organisations should have an emergency plan in place to quickly share safety information with the public.

What Do Schools Need to Do?

Under Martyn's Law, premises are classed into two groups based on their capacity. Sites with 200–799 people fall under the Standard Tier, while those with over 800 are classed under the Enhanced Tier. It is important to note that childcare establishments, schools, and further education sites with over an 800 capacity are classed within the Standard Tier. Whereas higher education establishments are treated as other premises in scope. If your organisation is not required to follow Martyn’s Law, applying its principles can still help to keep pupils and staff safe in the event of an incident.

As a Standard Tier site, your school will need to notify the SIA that you are in scope of the act and have 'reasonably practicable, appropriate public procedures' in place. Your procedures should cover evacuation, invacuation, lockdown, and communication. Together these focus on reducing the danger your pupils and staff may face during a terrorist attack.
